Is the property fee based on the building area or the usable area?

1. Usually, payment is made based on the built area, because the house purchase is also based on this area, which includes public areas.

2. The common area is also included in the routine cleaning and management of the property, so it is calculated based on the building area. The property fee is obtained by multiplying the building area by the unit price of the property fee.

3. Some may also include other services, for example, serviced apartment properties may provide services such as air ticket booking.

When does the property fee for a new house start to be calculated?

1. The owner's move-in begins when he goes to the property management office of the community to complete the check-in procedures and obtains the key to the new house. At this time, the owner should start paying the property management fee.

2. After the owner has completed the check-in procedures, the property management public service fee shall be paid monthly by the owner or user. For owners who have purchased but have not yet moved in, they shall pay 50% of the property management public service fee standard within one year. At the same time, in order to avoid some owners who speculate in real estate leaving their houses idle for a long time, it is stipulated that if they still have not moved in after one year, they shall pay 100% of the property management public service fee.

3. National laws and regulations do not specify how often property fees must be paid, so the payment time of property fees can be specified in the signed property management contract.

4. After receiving the occupancy notice issued by the developer, the owner shall start paying the property management fee according to the time on the occupancy notice, and all expenses and responsibilities of the house after that time shall be borne by the owner. In other words, from that day on, all rights and responsibilities of the house belong to the owner.

Can I refuse to pay the property management fee if the property management service is not good?

Refusing to pay property management fees is a breach of contract by the owner. Owners should protect their rights through legal means and channels. If the owner is not satisfied with the property management company, the owner committee can re-select the property management company. If no owner committee is established, more than two-thirds of the owners can jointly select the property management company. "The owner's refusal to pay property management fees is a unilateral breach of contract." Since there is a contract between the owner and the property management company, the owner's failure to pay property management fees is actually a violation of the spirit of the contract. The housing management department, especially the property management office, is the management department of the property company, and it should also play the role of coordinator between the owner and the property company.

Legal Basis:

Article 7 of the Property Management Regulations: Owners shall perform the following obligations in property management activities:

(1) Comply with the management regulations and the rules of procedure for owners' meetings;

(2) Comply with the rules and regulations regarding the use of common property parts and common facilities and equipment, and the maintenance of public order and environmental sanitation within the property management area;

(3) Implement the decisions of the owners' meeting and the decisions made by the owners' committee authorized by the owners' meeting;

(iv) Pay special maintenance funds in accordance with relevant national regulations;

(5) Pay property service fees on time;

(6) Other obligations prescribed by laws and regulations.
