Does 158 days include 15 days of caesarean section leave?

We all know that women working in Chinese companies are given a certain amount of summer vacation to give birth to children, commonly known as maternity leave. And it is paid maternity leave. In other words, the company will still pay you while you give birth to your baby at home. However, how long the actual prenatal check-up should be and how it should be arranged depends on the province or region to which the company is currently located and the company's management system. Not all maternity leave is the same for women.

According to relevant national regulations, from January 1, 2016, all women working in companies who give birth to children can enjoy the 98 days of maternity leave stipulated by the state, and can also enjoy an additional 60 days of maternity leave, and enjoy maternity insurance. In other words, women working in companies are legally entitled to 158 days of maternity leave.

During these 60 days, pregnant women with difficult labor can enjoy an additional 15 days of maternity leave; pregnant women with twins can enjoy an additional 15 days of maternity leave for each additional baby. Caesarean section is also one of the types of difficult labor. In other words, women who choose caesarean section can enjoy an additional 15 days of caesarean section leave in addition to 158 days of pregnancy check-up. By this calculation, a female employee who works in an enterprise and gives birth to a child by caesarean section can enjoy 173 days of maternity leave.

There are only 365 days in a year, and 173 days of maternity leave means that a woman can take nearly half a year of maternity leave after giving birth to a child. If the pregnant woman gives birth to twins or one baby, she can take a break for more than half a year. Therefore, many companies only recruit male employees when recruiting. Even if they recruit women, they will require that the women are not likely to give birth or have already given birth. In that case, companies will no longer need to give women maternity leave.

In other words, if there is no 15-day caesarean section leave in 158 days, pregnant women who deliver by caesarean section can take an additional 15 days of maternity leave. Of course, not all companies have this benefit. Generally, only large and reliable companies have this benefit, and ordinary small companies only have two or three months off. There are also some unreliable companies that do not provide benefits such as paid maternity leave for women when they give birth, which means they do not even have a single day of maternity leave.
