What is maternity leave during pregnancy?

Maternity leave means that a pregnant female employee undergoes prenatal check-up during working hours, which is counted as working hours. It cannot be treated as sick leave, personal leave or absenteeism. This means that you will also be counted as being present on the day of your prenatal check-up. The company cannot deduct money! According to Article 6 of the "Special Provisions on Labor Protection for Female Employees" adopted at the 200th Executive Meeting of the State Council on April 14, 2012, the time required for pregnant female employees to undergo prenatal examinations during working hours shall be included in their working hours. This article does not limit the number of prenatal examinations, that is, as long as they are normal and necessary prenatal examinations, they should be counted as working hours. It cannot be calculated based on sick leave, personal leave, maternity leave, absenteeism, etc.

National regulations on maternity leave

The state stipulates that female employees are entitled to maternity leave after pregnancy. Within the prescribed scope, pregnant women going to the hospital for maternity check-ups are treated as normal attendance. The specific regulations are as follows:

During the first to sixth months of pregnancy, you can enjoy one day off each month for pregnancy confirmation and health training, etc.;

During the 6th and 7th months of pregnancy, you can enjoy 1 day of leave each month;

In the 8th month of pregnancy, you can enjoy 2 days of vacation per month;

If the pregnancy is more than 9 months, you can enjoy 4 days of leave per month, but 2 days of leave are included in the pre-maternity leave.

How to calculate maternity leave

Our country has formulated special protection regulations for the labor of female employees: maternity leave, which is used to protect the legitimate rights and interests of women. Therefore, pregnant women can go to the hospital for normal maternity check-ups according to their own circumstances within the scope stipulated by the above state. The calculation method is: from the 1st to the 6th month of pregnancy, you can enjoy 1 day of vacation each month, which is used for pregnancy confirmation and health training, etc.; from the 6th to the 7th month of pregnancy, you can enjoy 1 day of vacation each month; from the 8th month of pregnancy, you can enjoy 2 days of vacation each month; for pregnancy above 9 months, you can enjoy 4 days of vacation each month, but 2 of them are included in the pre-maternity leave.

Do I need a certificate for maternity leave?

The law does not stipulate whether a certificate is required for maternity leave, and different companies and regions have different approaches. Some companies require you to provide a copy of each prenatal check-up appointment time, that is, the prenatal check-up appointment form. Some companies require you to provide prenatal check-up records, or a diagnosis certificate issued by a doctor, etc. In short, when you go for a prenatal checkup, just leave all the information. It is always better to have an explanation than nothing.
