What does the property fee include?

Property fees include the cleaning and sanitation costs of the community, the greening maintenance costs of the community, the order maintenance costs of the community, the wages of management and service personnel, social insurance and welfare expenses, the daily operation and maintenance costs of common property parts and common facilities and equipment, office expenses, depreciation of property management fixed assets and other expenses agreed by the owner.

There are properties in every community. The property management company will provide property management services to the property users or owners based on the property management service contract. The fees that the property users or owners should pay based on the property management service contract are called property management fees.

However, this does not mean that property fees are collected arbitrarily according to the situation of the property. In order to protect the legitimate rights and interests of owners and property management companies, the property charging behaviors are further formulated and standardized in accordance with the "Price Law of the People's Republic of China", "Property Management Regulations" and "Regulations on the Implementation of Clear Pricing for Goods and Services".

Is it necessary to pay property fees?

According to relevant laws and regulations, owners do not have to pay property fees in the following situations:

1. Because the house has not been delivered yet due to quality issues, the property management fee is paid by the developer.

2. If the property management company fails to perform its service obligations under the property management contract, all owners may refuse to pay, but there must be evidence to prove it.

3. The quality of services provided by the property management company does not meet the standards agreed in the property management contract.

4. The property management company does not have the original approval documents from the price management department.

5. The property management company arbitrarily increases charging items, expands the scope of charging, and increases charging standards.

Article 41 of the Property Management Regulations states that the owner shall pay the property service fee in accordance with the provisions of the property service contract. If the owner and the property user agree that the property user shall pay the property service fee, the owner shall be jointly and severally liable for payment in accordance with the agreement. For properties that have been completed but not yet sold or handed over to the property buyer, the property service fee shall be paid by the construction unit.

Can I not pay the property management fee if I don't live in the house?

1. You still have to pay property management fees even if you don’t live in the house.

2. All property service fees incurred after the house is delivered for use must be borne by the owner. If no one moves in within one year after the house is delivered, the owner can bear 70% of the property service fees for this vacant period.

3. However, this is only limited to the first year, and full payment is required after the second year.

Some owners do not live in the community, and the property management company is still carrying out daily management work such as cleaning, security, landscaping, maintenance of public facilities and equipment, etc., and there is no expenditure due to these reduced workload.
