What is the definition and classification of traffic accidents?

A traffic accident refers to an accident resulting in death, injury or property damage caused or occurring when a vehicle is running on a highway, street or other road.

Traffic accidents can be classified according to the objects of the traffic accidents, such as vehicle-to-vehicle accidents, vehicle-to-pedestrian accidents, vehicle-to-bicycle accidents, single vehicle accidents, vehicle-to-fixed object collision accidents, and railway crossing accidents.

Traffic accidents are classified according to the object of the violation of traffic rules. They can be divided into three types: motor vehicle accidents, non-motor vehicle accidents and pedestrian accidents.

What are the bases for traffic accident identification?

The basis for determining a traffic accident is: whether the parties involved have violated the law, whether there is a causal relationship between the violation and the accident, and how much role the violation played in the accident.

【Legal basis】

Article 60 of the "Regulations on the Procedures for Handling Road Traffic Accidents" stipulates that the traffic management department of the public security organ shall determine the responsibility of the parties based on the role of the parties' behavior in the occurrence of the road traffic accident and the severity of their fault.

(1) If a road traffic accident is caused by the fault of one party, the party shall bear full responsibility.

(2) If a road traffic accident occurs due to the fault of two or more parties, they shall bear primary liability, equal liability or secondary liability according to the role of their actions in the occurrence of the accident and the severity of their fault.

(3) If none of the parties is at fault for causing the road traffic accident and it is a traffic accident, none of the parties is responsible.

If one party intentionally causes a road traffic accident, the other party shall not be liable.

How to apply for traffic accident insurance

There are seven situations:

(1) The insured shall hand over the repair shop's invoice, detailed list, damage assessment form, driving license and insurance contract to the insurance company.

(II) After reaching an agreement with the insurance company, the insurance company shall pay the insurance compensation within ten days. If the insurance company believes that the materials provided by the policyholder are incomplete, it shall pay the lowest amount that can be appraised within two months.

(3) Receive the claim notice and insurance money.

(iv) If the insurance company refuses to issue a claim notice and does not provide compensation within two months.

The insured may also file a civil lawsuit with the People's Court where the insurance company is located or where the vehicle is registered.

(V) After the insurance company receives the evidence materials related to the insurance accident from the policyholder.

A list of evidence should be issued to the insured and signed and sealed.

(6) The insurance company issues a notice of refusal to pay a claim.

(VII) The insured may bring a civil action to the People's Court at the place where the insurance company is located or where the vehicle is registered.
